Jessica Clarke, a law professor at the University of Southern California, questioned the reasoning behind the Supreme Court potentially limiting its decision on health care for minors only. She co-authored a brief supporting the Biden administration’s position in a case challenging Tennessee’s ban on transition treatments for minors.
Jim Campbell, the head lawyer of Alliance Defending Freedom, a conservative legal organization that submitted a legal document in favor of Tennessee, stated that he believed the court’s decision in Skrmetti would influence the results of legal challenges against state policies that refuse to provide coverage for gender transition procedures for Medicaid recipients or state health insurance plan employees.
Mr. Campbell believes that the court’s decision will have a significant impact on issues related to bathrooms and sports, although he does not think it will directly dictate the outcomes of those cases.
